Refugee Status & Humanitarian Canada Immigration
The Canadian Government believes that every person, Canadian or Foreign National, is entitled to be protected from persecution. There are many interpretations and meanings to the term “refugee”, and there are many Foreign Nationals that enter Canada seeking refugee status.
Obtaining Refugee Status
In order to obtain refugee status, a claimant must prove that he or she has a well-founded fear of persecution in his or her home country, and that the persecution is based on reasons of race, nationality, membership of a particular social group and political opinion.
A refugee claimant must be outside his or her home country when claiming refugee status. Any trip home during the application process, will be taken as a sign that the claimant does not fear his or her home country any longer.
Those refugee applicants that make a claim outside Canada are part of a process called “resettlement.” In most cases, Canada will resettle a person based on a referral from an organization such as the United Nations High Commission for Refugees.
Humanitarian Application
Obtaining permanent residence status in Canada based on a Humanitarian application is rooted in a person’s personal connections and ties to Canada. If an applicant can prove that he or she has made significant ties to Canada during their stay, Immigration Canada will grant them Permanent Resident status based on Humanitarian and Compassionate grounds.
